First of all, you need to know the difference between algorithms, and "set the strategy on, and go to the beach" - since there is a big difference in regulations between the two.

I think few in this group are in the first group, even they claim they are in algos/algorithms.

Søren, recently there was a post here about how FINRA now is going to treat anything which involves orders sent automatically. Your argument was that it's only in the States; however what starts there, gets to EU in about a year. So, the problem only begins.

One of the bigger items is to store the log files to back up why decisions were made. If the regulator asks why did the price move dramatically at time X - you'll need to accurately report what happened and why. Need that on the smart order and dark pool logic too.

MAR and MiFID 2 in Europe will both require systems and controls that document the strategy (be that set and go to the beach, or constant updating). That means a clear articulation of the strategy, and the "investment process". that is: how do you decided which elements of the strategy are implemented and retained and at what point do you "kill" a pairing or an idea? is it X% of under performance or X% of under performance over X period of time? Or is it deviance from back testing data predictions or whatever your criteria is for the algorithm. Regulators will expect to see documentation on the controls built in to the algorithm to ensure that it is performing as expected and doesn't go out of control. What triggers your kill switch? They will also expect to see real time trend and real time monitoring of orders to prevent market abuse(for example versus executions to monitor for spoofing and layering).
