In my experience any trading venue (BATS, ARCA, etc.) will detect a trade with the same MPID on both sides. They will automatically send it to FINRA (required) and FINRA will automatically send a letter to broker/MPID requesting explanation. In general it takes only showing executions allocated to different clients or accounts to prove that beneficial change of ownership took place.

Boris, great point. I should have been more clear that this is the case outside of equities. Relatively new codified manipulation rules under Dodd-Frank, REMIT etc.
